Privacy Policy

Effective September 14, 2026

This policy covers rxbillion.com and our business services. It does not cover patient health information handled inside any client's telehealth business, which is governed by that business and its licensed providers under HIPAA.

This Privacy Policy describes how RX Billion LLC, a Texas limited liability company doing business as rxBILLION ("rxBILLION," "we," "us," or "our"), collects, uses, discloses, retains, and protects information in connection with the website located at rxbillion.com and its subdomains, pages, forms, scheduling links, and communications (collectively, the "Website"), and the business services we offer (the "Services"). This Privacy Policy is incorporated into and forms part of our Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.

BY ACCESSING OR USING THE WEBSITE, SUBMITTING ANY FORM, SCHEDULING OR ATTENDING A CONSULTATION, OR OTHERWISE PROVIDING INFORMATION TO US, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS PRIVACY POLICY. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY, DO NOT USE THE WEBSITE OR PROVIDE INFORMATION TO US.

1. Scope of This Policy; What This Policy Does Not Cover

1.1. This Privacy Policy applies to information we collect through the Website, through forms and scheduling tools embedded in or linked from the Website, through email, telephone, video, and text communications with us, and in the course of providing the Services to business clients.

1.2. This Privacy Policy does not apply to, and rxBILLION is not responsible for, the privacy practices of any third party, including any third-party website, platform, or service linked from the Website, any scheduling, analytics, hosting, email, payment, or communication provider we use (each of which processes information under its own privacy policy), or any clinician, pharmacy, laboratory, telehealth platform, or other Third-Party Provider with whom a client of ours may contract.

1.3. PATIENT AND HEALTH INFORMATION. rxBILLION is a business services company. rxBILLION is not a healthcare provider, health plan, or healthcare clearinghouse, and does not provide medical care, treatment, prescriptions, or medical advice to any patient. Any telehealth or health-related business that a client of ours may launch or operate (a "Client Business") is owned, operated, and controlled exclusively by that client and the licensed providers and pharmacies with which that client independently contracts. Any patient information, protected health information, medical records, prescriptions, or other health data created, received, maintained, or transmitted in connection with a Client Business is governed by that Client Business, its providers, and their own notices of privacy practices and obligations under the Health Insurance Portability and Accountability Act ("HIPAA") and applicable state law, and not by this Privacy Policy. rxBILLION does not intend to, and does not, collect, receive, access, store, or process patient protected health information in providing the Services. If you are a patient of a Client Business, please direct all privacy inquiries to that business and its providers.

2. Information We Collect

2.1. Information You Provide Directly. We collect information that you voluntarily provide to us, including:

(a) Contact and identification information, such as your first and last name, email address, telephone number, mailing address, company or business name, job title, and website or social media handles;

(b) Inquiry and application information, such as your responses to the questions in our consultation scheduling form and any application, questionnaire, or intake form, which may include information about your professional background, industry experience, business goals, current business activities, budget, timeline, and the type of Client Business you are considering;

(c) Communications, such as the content of emails, text messages, voicemails, chat messages, meeting notes, and call or video recordings (where permitted and disclosed) that you exchange with us;

(d) Client engagement information, if you become a client, such as billing and payment information (which is processed by our third-party payment processors and not stored in full by us), legal entity and ownership information, brand assets, credentials or access you provide for tools and accounts used in delivering the Services, and materials you provide for use in the Services;

(e) Marketing preferences and consents, such as your election to receive or not receive marketing communications, calls, or text messages; and

(f) Any other information you choose to provide to us.

2.2. Information Collected Automatically. When you access the Website, we and our service providers automatically collect certain information through cookies, pixels, tags, scripts, web beacons, local storage, and similar technologies ("Tracking Technologies"), including:

(a) Device and browser information, such as IP address, device type, operating system, browser type and version, language settings, screen resolution, and device identifiers;

(b) Usage information, such as the pages and content you view, the links and buttons you click (including clicks on our consultation and application links), the date, time, and duration of your visit, the referring website or source, search terms, and other interactions with the Website;

(c) Approximate location information derived from your IP address; and

(d) Analytics information generated by Google Analytics and similar tools, which may include pseudonymous identifiers, session data, and engagement metrics.

2.3. Information From Third Parties. We may receive information about you from third parties, including scheduling and calendar providers, email and communication providers, business information and data enrichment services, social media platforms (if you interact with us there), referral partners, publicly available sources, and, where applicable, background, credit, or verification services used in connection with a client engagement, to the extent permitted by applicable law.

2.4. Sensitive Information. We do not request, and ask that you do not provide, sensitive personal information such as Social Security numbers, government identification numbers, financial account numbers (other than through our secure third-party payment processors), health or medical information, genetic or biometric data, precise geolocation, or information revealing racial or ethnic origin, religious beliefs, sexual orientation, or citizenship or immigration status. If you provide such information, you do so voluntarily and consent to its processing as described in this Privacy Policy. We do not sell sensitive personal data.

3. How We Use Information

3.1. We use the information we collect for the following business and commercial purposes:

(a) To respond to your inquiries, schedule and conduct consultations, and communicate with you;

(b) To evaluate your inquiry or application, determine whether the Services are a fit, and qualify prospective clients;

(c) To provide, deliver, administer, and support the Services, including building, configuring, and delivering the deliverables described in a Client Agreement;

(d) To process payments, invoices, and transactions, and to detect and prevent fraud, chargebacks, and abuse;

(e) To operate, maintain, secure, monitor, analyze, and improve the Website and the Services, including understanding how visitors use the Website, measuring the performance of pages and campaigns, and diagnosing technical issues;

(f) To send you administrative communications, such as confirmations, reminders, updates, security alerts, and notices regarding changes to our terms or policies;

(g) With your consent where required by law, to send you marketing communications, including emails, calls, and text messages about our Services, offers, events, and content, and to personalize those communications;

(h) To comply with applicable law, regulation, legal process, and governmental requests, and to establish, exercise, or defend legal claims;

(i) To enforce our Terms of Service, Client Agreements, and other policies, and to protect the rights, property, safety, and security of rxBILLION, our clients, our personnel, and others;

(j) To create aggregated, de-identified, or anonymized data that does not identify you, which we may use for any purpose; and

(k) For any other purpose disclosed to you at the time of collection or to which you consent.

3.2. We do not use the information we collect to make decisions that produce legal or similarly significant effects concerning you through solely automated processing.

4. How We Disclose Information

4.1. We may disclose the information we collect to the following categories of recipients:

(a) Service Providers and Processors. Third parties that perform services on our behalf and are permitted to use information only as necessary to perform those services, including website hosting and content delivery providers, domain and DNS providers, scheduling and calendar providers, video conferencing providers, email and messaging providers, customer relationship management providers, analytics providers (including Google Analytics), tag management providers, payment processors and merchant service providers, electronic signature providers, document and file storage providers, project management and collaboration tools, and information technology and security providers;

(b) Professional Advisors. Attorneys, accountants, auditors, insurers, bankers, and other professional advisors, in connection with the professional services they provide to us;

(c) Third-Party Providers in Connection With the Services. If you become a client, and only as necessary to deliver the Services described in your Client Agreement, we may share your business contact information and relevant engagement details with the clinicians, provider groups, pharmacies, laboratories, technology platforms, vendors, and other Third-Party Providers to whom we introduce you or with whom we coordinate on your behalf. Each such Third-Party Provider processes information under its own privacy policy, and any relationship between you and that Third-Party Provider is governed by your separate agreement with it;

(d) Affiliates. Our current and future parent companies, subsidiaries, and affiliates under common ownership or control, for purposes consistent with this Privacy Policy;

(e) Business Transfers. A purchaser, successor, investor, lender, or other counterparty, and their advisors, in connection with any actual or proposed merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction, or in the course of due diligence for any such transaction;

(f) Legal, Safety, and Compliance. Courts, regulators, law enforcement, governmental authorities, and other parties, where we believe in good faith that disclosure is required or permitted by applicable law, regulation, subpoena, court order, or legal process, or is necessary to enforce our terms and policies, to protect the rights, property, or safety of rxBILLION, our clients, our personnel, or the public, to investigate fraud, security incidents, or illegal activity, or to respond to a government request; and

(g) With Your Consent or at Your Direction. Any other party to whom you direct us to disclose information or to whose disclosure you consent.

4.2. We do not sell personal data, and we have not sold personal data in the preceding twelve (12) months. We do not share personal data with third parties for their own direct marketing purposes. We do not sell or share sensitive personal data. We do not knowingly process personal data for targeted advertising, provided that our analytics and tag management providers may set cookies that could be considered cross-context tracking under certain state laws; you may opt out of such tracking as described in Section 6.

5. Cookies, Analytics, and Tracking Technologies

5.1. We use Tracking Technologies to operate the Website, remember your preferences, understand how visitors use the Website, measure the effectiveness of our pages and campaigns, and improve the Website and the Services. The Tracking Technologies we use include:

(a) Strictly necessary technologies required for the Website to function and to maintain security;

(b) Analytics technologies, including Google Analytics 4 provided by Google LLC, which uses cookies and similar identifiers to collect information about your use of the Website and to generate reports about Website activity and engagement. Google may use the data collected to contextualize and personalize ads within its own advertising network, subject to its own privacy policy. You can learn how Google uses information from sites that use its services at policies.google.com/technologies/partner-sites, and you may opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on available at tools.google.com/dlpage/gaoptout; and

(c) Third-party embedded tools, such as scheduling widgets, which may set their own cookies subject to their own privacy policies.

5.2. Third parties whose Tracking Technologies are present on the Website may collect information about your online activities over time and across different websites and online services when you use the Website. We do not control those third parties' Tracking Technologies or how they use the information they collect.

5.3. Do Not Track. Some browsers offer a "Do Not Track" ("DNT") signal. Because there is no industry standard for recognizing or honoring DNT signals, the Website does not currently respond to DNT signals. We do, however, honor Global Privacy Control ("GPC") signals as an opt-out of any sale or sharing of personal data or targeted advertising to the extent required by applicable law.

5.4. Managing Cookies. Most browsers allow you to refuse or delete cookies through their settings. If you disable cookies, some features of the Website may not function properly. Instructions for managing cookies in common browsers are available from each browser's help documentation.

6. Your Privacy Rights and Choices

6.1. Rights That May Be Available to You. Depending on your state or country of residence, you may have some or all of the following rights with respect to your personal data, subject to applicable law and certain exceptions:

(a) The right to confirm whether we are processing your personal data and to access that personal data;

(b) The right to correct inaccuracies in your personal data;

(c) The right to delete personal data provided by or obtained about you;

(d) The right to obtain a copy of your personal data in a portable and, to the extent technically feasible, readily usable format;

(e) The right to opt out of the processing of your personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects;

(f) The right to withdraw consent where processing is based on consent; and

(g) The right to appeal our decision regarding a rights request.

6.2. How to Exercise Your Rights. You may exercise your rights by emailing us at hello@rxbillion.com with the subject line "Privacy Request," or by writing to us at RX Billion LLC, Attn: Privacy, 5900 Balcones Drive, Suite 100, Austin, Texas 78731. Please include your full name, the email address and telephone number you used with us, your state of residence, and a description of the right you wish to exercise. We will take reasonable steps to verify your identity before responding, which may include confirming information you previously provided to us. An authorized agent may submit a request on your behalf if the agent provides written authorization signed by you and we are able to verify your identity.

6.3. Response Timing. We will respond to a verified request without undue delay and in any event within forty-five (45) days of receipt, which period may be extended once by an additional forty-five (45) days where reasonably necessary, in which case we will inform you of the extension and the reason for it within the initial forty-five (45) day period. We will not charge a fee for responding to your request unless requests are manifestly unfounded, excessive, or repetitive, in which case we may charge a reasonable fee or decline to act. If we decline to take action on your request, we will inform you of the reason and of your right to appeal.

6.4. Appeals. If we decline to act on your request, you may appeal our decision within a reasonable period by replying to our response or emailing hello@rxbillion.com with the subject line "Privacy Appeal." We will respond to your appeal in writing within sixty (60) days of receipt, explaining any action taken or not taken and the reasons. If your appeal is denied and you are a Texas resident, you may submit a complaint to the Texas Attorney General at texasattorneygeneral.gov. Residents of other states may contact their state attorney general or privacy regulator.

6.5. Non-Discrimination. We will not discriminate against you for exercising any privacy right, including by denying services, charging different prices, or providing a different level or quality of service, except as permitted by applicable law.

6.6. Marketing Communications. You may opt out of marketing emails by clicking the unsubscribe link in any marketing email or by contacting us as described above. You may opt out of marketing text messages by replying STOP to any message. You may opt out of marketing calls by informing the caller or by contacting us. Please note that even after you opt out of marketing communications, we may continue to send you non-promotional, transactional, or administrative communications, such as consultation confirmations, engagement-related communications, invoices, and notices regarding changes to our terms or policies.

6.7. Texas Residents. rxBILLION currently qualifies as a small business as defined by the United States Small Business Administration and, as such, is not currently subject to the majority of the obligations of the Texas Data Privacy and Security Act, Texas Business and Commerce Code Chapter 541. Notwithstanding the foregoing, we voluntarily extend the rights described in this Section 6 to Texas residents, and we do not sell sensitive personal data. We will update this Privacy Policy if our obligations under Chapter 541 change.

6.8. California Residents. If you are a California resident, the California Online Privacy Protection Act requires us to disclose the categories of personally identifiable information we collect (see Section 2), the categories of third parties with whom we may share it (see Section 4), the process by which you may review and request changes to your information (see Section 6.2), how we notify you of material changes to this Privacy Policy (see Section 10), the effective date of this Privacy Policy (above), and how we respond to Do Not Track signals (see Section 5.3). If the California Consumer Privacy Act, as amended by the California Privacy Rights Act, applies to us, California residents may additionally exercise the rights described in Section 6.1 and may contact us to request the information required by that law.

6.9. Residents of Other States. Residents of Virginia, Colorado, Connecticut, Utah, Oregon, Montana, Iowa, Indiana, Tennessee, Delaware, New Jersey, New Hampshire, Nebraska, Maryland, Minnesota, Kentucky, Rhode Island, and any other state with a comprehensive privacy law may exercise the rights described in Section 6.1 to the extent such law applies to us. rxBILLION may not currently meet the applicability thresholds of those laws, but we extend the rights described in this Section as a matter of policy.

6.10. Residents Outside the United States. The Website and the Services are directed to persons in the United States. If you access the Website from outside the United States, you acknowledge that your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those of your jurisdiction, and you consent to such transfer, storage, and processing.

7. Calls and Text Messages; Telephone Consumer Protection Act

7.1. By providing your telephone number to us through the Website, a scheduling form, or otherwise, you expressly consent to receive telephone calls and text messages from or on behalf of rxBILLION at that number for the purposes of responding to your inquiry, scheduling and confirming consultations, and providing the Services. Where you have separately provided prior express written consent, we may also send you marketing calls and text messages, including messages sent using an automatic telephone dialing system or an artificial or prerecorded voice.

7.2. Consent to receive marketing calls or texts is not a condition of purchasing any Services. Message frequency varies. Message and data rates may apply. You may revoke consent to text messages at any time by replying STOP, and may obtain help by replying HELP. Revoking consent to marketing messages does not affect messages necessary to complete a transaction or engagement you have requested.

7.3. You represent that you are the subscriber or customary user of any telephone number you provide to us, and you agree to notify us promptly if you cease to use that number.

8. Data Retention

8.1. We retain personal data for as long as reasonably necessary to fulfill the purposes for which it was collected, to provide the Services, to comply with our legal, regulatory, tax, accounting, and reporting obligations, to resolve disputes, to enforce our agreements, and to establish, exercise, or defend legal claims. The criteria we use to determine retention periods include the nature and sensitivity of the data, the purposes for which we process it, the duration of any client relationship, applicable statutes of limitation, and legal and regulatory requirements.

8.2. Inquiry and consultation information for prospects who do not become clients is generally retained for up to three (3) years from the date of last contact. Client engagement records are generally retained for the duration of the engagement and for seven (7) years thereafter. Website analytics data is retained in accordance with the retention settings of our analytics providers. We may retain aggregated, de-identified, or anonymized data indefinitely.

8.3. Where we no longer need personal data, we will delete, de-identify, or anonymize it, or, where this is not possible (for example, because the data is stored in backup archives), we will securely store it and isolate it from further processing until deletion is possible.

9. Data Security

9.1. We implement and maintain reasonable administrative, technical, and physical safeguards designed to protect personal data against unauthorized access, acquisition, disclosure, alteration, and destruction, appropriate to the nature of the data and the size and complexity of our business, as required by Texas Business and Commerce Code Section 521.052 and other applicable law. These safeguards include the use of reputable third-party hosting and service providers, encryption of data in transit, access controls, and limitation of access to personnel and contractors with a need to know.

9.2. No method of transmission over the internet or method of electronic storage is completely secure. Accordingly, while we strive to protect personal data, we cannot guarantee, and do not warrant, the absolute security of any information you transmit to us or that we store, and you provide information to us at your own risk. You are responsible for maintaining the confidentiality of any credentials you provide to us and for using appropriate security measures on your own devices and accounts.

9.3. In the event of a breach of system security involving sensitive personal information, we will notify affected individuals and, where required, regulators, in accordance with Texas Business and Commerce Code Section 521.053 and other applicable breach notification laws.

10. Changes to This Privacy Policy

10.1. We may update this Privacy Policy from time to time to reflect changes in our practices, the Website, the Services, technology, legal requirements, or other factors. When we make changes, we will revise the "Last Updated" date at the top of this Privacy Policy and post the revised Privacy Policy on the Website. If we make material changes that expand our use or disclosure of previously collected personal data, we will provide additional notice, such as by email to the address we have on file or by a prominent notice on the Website, and, where required by applicable law, we will obtain your consent.

10.2. Your continued use of the Website or the Services after the effective date of any revised Privacy Policy constitutes your acknowledgment of the revised Privacy Policy. We encourage you to review this Privacy Policy periodically.

11. Children's Privacy

11.1. The Website and the Services are intended for adults and businesses and are not directed to children under the age of eighteen (18). We do not knowingly collect personal data from children under the age of thirteen (13), and we do not knowingly allow persons under eighteen (18) to use the Website or the Services. If we learn that we have collected personal data from a child under thirteen (13) without verifiable parental consent, we will delete that information promptly. If you believe a child has provided us with personal data, please contact us at hello@rxbillion.com.

12. Third-Party Websites and Services

12.1. The Website may contain links to, or integrations with, third-party websites, platforms, tools, and services, including scheduling tools, video conferencing tools, social media platforms, and the websites of Third-Party Providers. This Privacy Policy does not apply to those third parties, and we are not responsible for their content, privacy practices, or security. We encourage you to review the privacy policy of every third-party website or service you visit or use.

13. Business Clients and Client-Provided Data

13.1. If you are a client, you may provide us with information about your own personnel, contractors, customers, or other third parties in the course of the Services ("Client-Provided Data"). You represent and warrant that you have all rights, consents, notices, and lawful bases required to provide Client-Provided Data to us and to authorize our processing of it as contemplated by your Client Agreement, and you shall not provide us with any protected health information, patient data, or other information subject to HIPAA or similar law unless a written business associate agreement or equivalent has first been executed between us. We process Client-Provided Data solely on your instructions and in accordance with your Client Agreement, and you remain the controller of and responsible for such data.
